1. Introduction

Welcome to RHS Boating & Marine, an Australian online retailer of boating, marine, fishing, anchoring, electrical, safety and trailer accessories.

These Terms and Conditions of Sale govern the purchase of products through our website, www.rhsboating.com.au.

RHS Boating & Marine is a trading name of P & D Imports Pty Ltd (ABN 60 645 653 050), referred to in these terms as "RHS Boating & Marine", "we", "us" or "our".

By placing an order through our website, you agree to these Terms and Conditions of Sale, subject to your rights under Australian law.

2. Product Information and Accuracy

We take reasonable care to ensure product descriptions, images, prices, specifications, measurements and availability information are accurate.

Our product range includes marine hardware, boat anchors, mooring equipment, trailer parts, lifejackets, marine electrical products, plumbing equipment and general boating supplies.

Please note:

  • Product photographs may be representative of the item sold.

  • Packaging, colours and manufacturing details may vary, provided the goods remain consistent with their description and applicable consumer guarantees.

  • Product dimensions, capacities and weights may be approximate where expressly identified as such.

  • Manufacturers may revise specifications without prior notice.

  • Product compatibility must be checked against your particular vessel, motor, trailer or application.

We will not knowingly supply materially different products without informing you and obtaining your agreement where required.

Nothing in this section limits our obligations to provide goods that match their description, sample or demonstration model under Australian Consumer Law.

3. Pricing, GST and Currency

All advertised prices are in Australian dollars (AUD) and include GST where applicable, unless otherwise clearly stated.

Delivery charges, if applicable, will be displayed or confirmed before purchase.

We reserve the right to update product pricing for future orders.

If a genuine pricing or listing error is identified before an order has been accepted, we may contact you with the corrected information and offer you the opportunity to proceed or cancel.

If payment has been collected for an order that cannot be fulfilled and no acceptable alternative is agreed, we will provide an appropriate refund.

4. Orders and Acceptance

When you submit an order, you are making an offer to purchase the selected products.

An automated acknowledgement confirms receipt of your order but does not necessarily constitute acceptance.

An order is accepted when we expressly confirm acceptance or dispatch the products.

We may decline an order for legitimate reasons, including unavailable stock, payment failure, reasonable fraud concerns, transport restrictions or a material listing error.

If an order cannot be fulfilled after payment has been taken, we will contact you and provide an appropriate refund or another solution agreed with you.

5. Product Availability

We endeavour to keep stock information accurate.

Products may be supplied from our inventory or through approved suppliers and distribution arrangements.

Occasionally, items may be unavailable, discontinued or subject to supply delays.

Where a material availability issue affects your order, we will contact you to discuss the expected timeframe or available alternatives.

You may be entitled to cancellation and a refund where required by Australian Consumer Law.

6. Payment Methods

We accept eligible online payments through:

  • eWAY secure payment processing.

  • PayPal.

Available card and payment options are displayed during checkout.

Payment is generally required before dispatch.

We may perform reasonable security and fraud prevention checks before accepting or processing an order.

Payment transactions are subject to the relevant payment provider's terms and conditions.

We do not apply payment surcharges prohibited under applicable laws or payment provider rules.

Further details are available in our Payment Information Policy.

7. Shipping and Delivery

We arrange delivery of eligible products throughout Australia using Australia Post.

Shipping availability and charges depend on the size, weight, classification and delivery destination of the products purchased.

Some large, heavy or restricted marine products may require alternative delivery arrangements.

Delivery timeframes are estimates unless expressly agreed otherwise.

Customers must provide accurate delivery information.

We remain responsible for meeting our obligations concerning the delivery and supply of goods under Australian Consumer Law.

Additional information is provided in our Delivery & Shipping Policy.

8. 30-Day Change-of-Mind Returns

RHS Boating & Marine offers a 30-day change-of-mind returns policy for eligible purchases.

Customers may request a return within 30 calendar days of receiving their goods.

To qualify for a discretionary change-of-mind return:

  • Goods must be unused and in resaleable condition.

  • Goods must not have been installed, modified or damaged.

  • Original packaging, manuals and accessories must be provided where reasonably applicable.

  • Proof of purchase must be available.

  • The return request must be submitted within the 30-day period.

Change-of-mind return postage is generally the customer's responsibility.

Special-order, customised, altered, installed or otherwise ineligible products may be excluded from discretionary change-of-mind returns.

These restrictions do not apply where customers are entitled to remedies under Australian Consumer Law.

For further information, refer to our Returns & Refunds Policy.

9. Australian Consumer Law Guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Your rights may include remedies for goods that are faulty, unsafe, incorrectly described or not fit for a disclosed purpose.

Your statutory rights are not restricted to our 30-day change-of-mind returns period.

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee or other statutory right that cannot lawfully be excluded.

10. Manufacturer Warranties

Certain products may include additional manufacturer's warranties.

These warranties operate in addition to statutory consumer guarantees.

Warranty terms and periods vary by product and manufacturer.

Where customers are entitled to a remedy from RHS Boating & Marine under Australian Consumer Law, we will not require them to resolve the matter solely with the manufacturer.

11. Marine Product Safety and Installation

Certain marine products require correct selection, installation, maintenance and use.

Examples include:

  • Lifejackets and personal flotation devices.

  • Anchoring and mooring systems.

  • Marine electrical equipment.

  • Fuel systems and related components.

  • Trailer brakes, hubs and towing equipment.

  • Navigation and communication equipment.

Customers should follow manufacturer instructions, relevant safety requirements and applicable marine regulations.

Where qualified installation or inspection is required, we recommend engaging an appropriately licensed or qualified professional.

We are not responsible for damage caused solely by improper installation, misuse or unauthorised alteration, except where liability cannot lawfully be excluded.

12. Order Cancellation

Customers wishing to cancel an order should contact This email address is being protected from spambots. You need JavaScript enabled to view it. as soon as possible.

We will consider cancellation requests based on the order's processing and dispatch status.

Orders that have already been dispatched are subject to our Returns & Refunds Policy and applicable consumer rights.

Specially sourced, manufactured, cut-to-size or customised products may be ineligible for discretionary cancellation once processing has commenced.

This does not limit cancellation rights or remedies available under Australian Consumer Law.

13. Title and Risk

Ownership of goods generally transfers once the purchase price has been paid in full and the goods have been supplied, subject to applicable law.

Responsibility for loss or damage during delivery is determined by the applicable legal requirements and delivery arrangements.

Nothing in these terms removes rights or remedies available where goods are not supplied, are damaged in transit or otherwise fail to meet applicable consumer guarantees.

14. Limitation of Liability

To the maximum extent permitted by law, we are not liable for losses arising solely from circumstances outside our reasonable control or from product misuse that is not attributable to a failure by us to meet our legal obligations.

We do not exclude liability for fraud, negligence or breaches of statutory obligations where such liability cannot lawfully be excluded.

Nothing in these terms limits remedies or compensation available under Australian Consumer Law.

15. Privacy and Customer Information

Personal information collected in connection with orders is handled in accordance with our Privacy Policy and applicable privacy laws.

Customer information may be shared with payment providers, shipping providers and relevant service partners where reasonably necessary to process and fulfil orders.

Please refer to our Privacy Policy for more information.

16. Disputes and Complaints

We encourage customers to contact us promptly if an issue arises with an order.

Please email This email address is being protected from spambots. You need JavaScript enabled to view it. with your order reference and a description of the issue.

We will endeavour to investigate and resolve complaints fairly and within a reasonable timeframe.

Nothing in these terms prevents customers from contacting NSW Fair Trading, the Australian Competition and Consumer Commission or another appropriate dispute resolution or regulatory body.

17. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia, and applicable Commonwealth laws.

Mandatory consumer protection laws continue to apply regardless of this governing law clause.

18. Changes to Terms and Conditions

We may update these Terms and Conditions to reflect changes in our operations, suppliers, payment methods or legal requirements.

The updated terms will be published on our website.

Unless otherwise lawfully agreed, changes will not retrospectively alter the terms applicable to purchases already made.
