1. Our Commitment to Customers

RHS Boating & Marine is committed to supplying quality boating and marine products that comply with applicable Australian consumer protection laws.

Our products are supplied with consumer guarantees under the Australian Consumer Law (ACL), where applicable.

These guarantees operate independently of any additional manufacturer or supplier warranty.

2. Your Rights Under Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

These rights cannot be excluded or reduced by our store policies or a manufacturer's warranty.

3. What Consumer Guarantees Cover

Depending on the circumstances, Australian Consumer Law requires that goods:

  • Be of acceptable quality, safe and durable.

  • Be fit for their usual purpose.

  • Be fit for a particular purpose disclosed to the seller, where applicable.

  • Match their description and any relevant sample or demonstration model.

  • Meet express promises about product quality or performance.

  • Have appropriate title and ownership rights.

  • Meet other applicable consumer guarantees.

These guarantees apply to eligible purchases regardless of whether a separate manufacturer's warranty is supplied.

4. Manufacturer Warranties

Some marine products carry additional warranties from their manufacturers or distributors.

Warranty coverage varies according to the product, manufacturer and warranty terms.

A manufacturer's warranty may provide additional repair, replacement or support services.

Manufacturer warranty periods do not determine the duration of Australian Consumer Law rights.

Even after a manufacturer warranty has expired, customers may still have statutory consumer guarantee rights.

5. Major Product Failures

A major failure may occur when a product is unsafe, substantially unfit for its normal purpose, substantially different from its description, or affected by another problem meeting the statutory definition of a major failure.

Where a major failure occurs, an eligible consumer may generally choose between a refund and a replacement, subject to the Australian Consumer Law.

Other compensation may also be available where legally required.

6. Minor Product Failures

Where a product has a failure that is not major, we may be entitled to provide an appropriate remedy, such as a repair, within a reasonable time.

If the problem cannot be remedied, or is not remedied within a reasonable time, the customer may become entitled to further remedies.

We will assess claims fairly according to the circumstances and applicable law.

7. Products Requiring Specialist Installation

Some products, including marine electrical components, fuel system parts, navigation equipment and trailer components, may require installation by a suitably qualified person.

Damage caused solely by incorrect installation, abnormal use, neglect or unauthorised modification may not be covered by a voluntary manufacturer warranty or give rise to a consumer guarantee remedy where the seller is not responsible for the problem.

However, incorrect installation does not automatically eliminate all statutory rights.

Each claim will be assessed according to its cause and applicable law.

10. Our 30-Day Returns Policy

In addition to statutory consumer guarantees, RHS Boating & Marine offers a discretionary 30-day change-of-mind returns policy for eligible products.

The 30-day period begins when customers receive their goods.

Conditions for change-of-mind returns are explained in our Returns & Refunds Policy.

We will review complaints fairly and endeavour to provide a response within a reasonable time.

Customers may also contact NSW Fair Trading or another appropriate consumer protection body.
